Its always worth it to fight it !

You have nothing to lose, you can sit on your but and pay up or go and take the chance of not paying it. Not to mention if you pay it you insurance doubles next month.

Plus this ticket is totally rediculous, being that the park ranger could not give us a better explination other then "common sense" what is illegal and what is not. My common sense tells me that where he was was ok based on there is an opening to a trail behind the water hole, that and I was there before and other park rangers were watching and laughing at me playing in that same hole.

As far as i am concerned this is no different then a cop writing you a ticket for speeding when you never left the house.

 

Basically I figured it this way. I really don't know what I did wrong or how to even tell I didn something wrong. Like Ben said the only answer she coudl give us was "common sense". My basis on whether I fought the ticket or not was the price. $74 is still a good size ticket for something like that. I am going to try and get some pics of the actual "trails" that are loaded with water and ice and some pics of where I was when I got the ticket. If I end up still having to pay the so be it but atleat I know I tried to defend myself against some PMS ridin Yogi Bear Watching Park Ranger.

I also think about t this way. If I do fight it whether I will or lose I will maybe get a definate answer to "trail" or "no trail" and it can better this forum so that nobody else gets banged with the same thing.

Ben, Winks, Earl, or Fletch I need some pics of big mud holes in the actual trail. Something like the area we where at before we went down that trail I got ticketed on. You know right there by the bridge we went over.

Thats a good idea I think Since i was there too! Get or print out the pictures out of here. There was some big as "water holes" **** even th 1/4 mile mudd pics are in there!

 

I think that even if you were on a trail they may still come at you with an offroading fine of some sort for not treading lightly. Going through the same hole for the sake of getting dirty is not treading lightly. I will say that I probably would have done it too but none the less you could be said to have been being reckless. These are street legal roads and if you can get busted for doing a burnout then you sure as hell can get busted for horsing around in the middle of the road. I don't want to get flamed for this post but I do plan on going to Wharton on the 31st and having "fun" I will just make sure to keep an eye out. I actually hope that you guys are all willing to come back out and go with me on the 31st. Just be safe.
