Save The "Beater"

Hey Everybody,

Since Mike (SJ Emergency Lighting) got a ticket for "off-roading" while off-roading, and because we don't know how much it is since the officer will be sending it in the mail, I wanted to post a poll to see how much everyone thinks the fine will be.

PS-Anybody who wants to donate to the "Save the Beater" fund can send a $1.00 donation to the following address:

if its tresspassing u cant take any kinda driving classes, my guess ticket will be $2-500...least around here and it can max at $600 and impoundment of ur vehicle.

i got one when i was younger for riding a four wheeler thru a park (apperntly you can't ride around on the baseball diamonds at night, lol). it was somethign like 52 dollars. his might be a little more though.

I've goten a ticket for that on federal forestry land or something, it was 75$.

there is a diffrence between a trespassing ticket and an off-roading ticket

NO NO NO it was not Tresspassing ! It was literally for off-roading. We were in wharton and its all perfectly legal if you stay on the trails, the officer claimed he was not on a trail and there for "off-roading"

He was in the same hole winks got stuck in the last time we were out with Griggs, I thought stuff like that was ok. It clearly looks like a trail to me. There is a trail behind the water hole that leads back into the woods farther. It comes around and back into the main trail. I know I sometimes think like a lawyer but I really can't see how they can enforce a law on something like that. Somebody asked the cop how the non-trails were marked and she said "common sense". My common sense tells me that is a trail.

Personally I would take that to court and fight it, but I do that with every ticket. Its would be easy to fight to, I would get some pictures of that mud hole and the trail opening behind it and pictures of other mud holes that are just as bad that are in the middle of the trails.

I can totally understand you making your own road through the woods yeah thats a problem for several reasons and they should give you a ticket for that, but not what he was doing.

I agree with Ben on this one. I saw the videos myself. Sounds to me like there is a case against it since R-F as an organization prides itself on not destroying the forest and being curtious where we wheel so we are allowed to continue doing this.

Yeah I have personally bagged and taken trash and stuff out of wharton before. This is the tanks we get.

i really don't care if r-f gets mentioned.

in fact, some print outs of previous meet, showing the care, and enthusiasm, surrounding a "r-f meet" at wharton, could show that he had no intention of doing anything illegal.

most of the time, it's the "mens rea" of a crime, that makes you guilty. the intent or state of mind.

more or less. i'd have to reference one of my cj books, but of course they all relate to texas/federal law, for the most part.

i'd say, if he wasn't knowingly "offroading", had no intention of "offroading", and didn't destroy anything, he could get off... since ya'll were on legal trails, and where he was looked like a legal trail... if he fights it with a pleasant attitude, and a semi-decent defense that would take less than an hour to prepare for(ie: my idea, on printouts)...

My guess is it'll be between 100-150. NJ likes to make you thier ***** when it comes to fines and tickets.

I will wait and see how much the ticket is when I get it before I decide what i am going to do.

I was going to put this in the Off-Topic and it was going to be my little rant but this seems like a fitting place for it!!!!

I know I have seen on R-F many times that people don't want to wheel in Fort Mott or Wingate due to legal reasons. Well I think it is F'd Up that i have been Wheelin in those places since I have had my DL and have never had a problem. I go to Wharton were everybody tells me it is legal and i get a freakin ticket. So now I have spent the gas money to tow my truck to Wharton plus the gas money for the "beater", Broke a Air pump, Borke a Off-Road light, and I have to pay a gosh darn ticket. So far I'm ready to just stick to Fort Mott and Wingate where I can be in under 5 Min. You know what I say **** THAT PMSING PARK RANGER *****.

Ok now that I have said that I feel a little better. I will go back to Wharton again why because I had a blast riding around with the people from this forum. I would have to say all of the wheelin I have done that was some of the most fun(until the ticket and the no power steering) The group that came out was awesome and I will be making that trip many more times I'm sure of it. Special thanks to Crazzyearl for use of his trailer. I am hoping after the first of the year i can buy the steel and a guy from my Firehouse is going to make me a trailer.

Well thanks for the support I will defenitly let everyone know when I get the ticket.

around here, it's real hard to get a trailer to pass all the inspections, register it, etc.. so i have been told. lots and lots of rules on trailers.

most of the time it's worth it to buy an old trailer, fix it up, than to build one from scratch.

To register a trailer here, all you have to do is show the bill-of-sale if its bought, and they give you a tag. I love georgia.

I have to say again, I am sorry about you getting a ticket, I have seen the park rangers in there before and never had a problem. I feel really bad for what happended. We were in that same hole one other time and a park ranger drove by and watched and laughed at us playing and this be otch has to come along and give us a hard time, if this is a taste of things to come I will stop going to wharton. pi$$ on them there are other places to wheel.

Also man I have no problems going to court with you to help you fight this you can call me as a witness or something.

Thanks Ben. It isn't your fault man I decided to play in that hole. If my Air Pump hadn't locked up I woudl have been out before she even got there so. It's not a big deal. Like I said I am going to wait and see what happens with the ticket first. I'll let you know.

It is looking like more court date will be 1-11-06. I am planning on fighting it at this point.
